These Terms of Use (“Terms”) govern your use of the NAKITA iPhone application and related services (the “Service”) operated by NAKITA (“we”, “us”). By creating an account or using NAKITA, you agree to these Terms.
The Service
NAKITA helps you organize and recall physical belongings using photos and nested locations. Features may change over time. Some features require a paid subscription (Nakita Plus).
Accounts
You are responsible for your account credentials and for activity under your account. Provide accurate information and keep your password secure. You must be able to form a binding contract in your jurisdiction to use the Service.
Your content
You retain ownership of the photos and inventory data you submit. You grant us a limited license to host, store, process, and display that content solely to operate the Service (including optional photo identify when you use it). You represent that you have the rights needed to upload your content.
Acceptable use
- Do not misuse the Service, attempt unauthorized access, or disrupt our systems.
- Do not upload unlawful, infringing, or harmful content.
- Do not use photo identify or other features to violate others’ privacy or rights.
Subscriptions & billing
Nakita Plus and other paid features are purchased through Apple. Payment is charged to your Apple ID. Subscriptions renew automatically unless canceled in your Apple ID settings at least 24 hours before the end of the current period. Refunds are handled by Apple according to Apple’s policies. We do not process card payments directly.
Free plan limits
The free plan may limit the number of locations, items, or features. Limits may change; the app will indicate when an upgrade is required.
Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, or that photo identify suggestions will be accurate.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by nature should survive will survive termination.
Changes
We may update these Terms by posting a revised version on this page. Continued use after changes means you accept the updated Terms.
